Introduction

This software including access to the SCOP databases and any associated documentation whether electronic or printed (hereinafter called "SCOP PACKAGE") is made available under a licence agreement and may be used only in accordance with the terms of that agreement. This is a legal agreement between you (the Licensee), and MRC. The terms of the licence are provided in the following pages.

Academic users do not need to register and are granted a free licence.

Corporate users are required to register and to pay an annual fee for access to the SCOP PACKAGE. Details of fees and the procedure for registration and acceptance of the licence terms is provided here.

By accessing the SCOP PACKAGE itself or completing and sending the registration you demonstrate your agreement to the terms of this licence and will become legally bound to the terms therein. Note that access to the SCOP PACKAGE is recorded.

Licensing the SCOP PACKAGE allows the user access to the databases only.

It should be emphasised that structural classification provided in the SCOP PACKAGE is by its very nature partly subjective. The MRC cannot offer advice on interpretation of the data within the SCOP PACKAGE. Any assistance will be strictly limited to attempting to help if there are problems accessing the database with the SCOP PACKAGE.

MRC makes no representation or warranties with respect to the SCOP PACKAGE or any databases accessed through the SCOP PACKAGE and specifically disclaims any implied warranties of merchantability and fitness for a particular purpose. MRC reserves the right to revise the software or SCOP and to make changes therein from time to time without obligation to notify any person or organisation of such revision or changes. While MRC will make every effort to ensure the accuracy of the SCOP PACKAGE neither MRC nor its employees or agents may be held responsible for errors, omissions or other inaccuracies or any consequences thereof.

LICENCE TERMS

DEFINITIONS:

The term "SCOP PACKAGE" as used in this Agreement means the software enabling access to the SCOP database, the database itself and any associated documentation whether electronic or printed, together with any updates subsequently supplied by MRC.

This licence agreement gives you (the Licensee) certain limited rights to use the SCOP PACKAGE. The Licensee does not become the owner of, the MRC retains title to all of, the SCOP PACKAGE. Licensee assumes responsibility for the selection and use of the SCOP PACKAGE to achieve intended results, and for the installation, use and results obtained from the SCOP PACKAGE. All rights not specifically granted in this Licence are expressly reserved by MRC.

GRANT OF LICENCE:

MRC grants the Licensee, a non-exclusive licence and right to use the SCOP PACKAGE.

If a network version of the SCOP PACKAGE is purchased you are bound by the terms and conditions of the separate Network Licence Agreement.

USES:

You may use the SCOP PACKAGE for access to the SCOP databases through the Internet provided that you comply with the terms of this Licence or the terms and conditions of the Network Licence Agreement if a network version of the SCOP PACKAGE was purchased.

WARRANTY:

EXCEPT AS STATED ABOVE, THE LICENSED PROGRAM IS PROVIDED "AS IS" WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL MRC BE LIABLE FOR LOSS OF PROFIT, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS, INCLUDING BUT NOT LIMITED TO SPECIAL INCIDENTAL CONSEQUENTIAL OR OTHER DAMAGES. LICENSEE WILL NOT HOLD MRC OR ITS EMPLOYEES OR AGENTS RESPONSIBLE FOR ANY CONSEQUENCES ARISING FROM LICENSEE'S USE OF THE PACKAGE. LICENSEE WILL HOLD HARMLESS MRC FOR ANY LOSSES OR DAMAGES OF WHATSOEVER NATURE ARISING FROM LICENSEE'S USE OF THE SCOP PACKAGE.

COPYRIGHTS:

The SCOP PACKAGE is owned by MRC and is protected by copyright laws. The SCOP PACKAGE has been provided to the end user pursuant to the of this Agreement.

This Agreement is governed by the laws of England.
